Please read these Terms & Conditions of Sale carefully before placing an order. By purchasing from FoamTec, LLC (“FoamTec,” “we,” “us,” or “our”), you agree to the policies outlined below.
These terms apply to all purchases made through our website, purchase orders, phone orders, estimates, or any other sales channel.
FoamTec reserves the right to update or modify these Terms & Conditions at any time. Continued use of our site or purchase of our products constitutes acceptance of any revisions.
Order Acceptance
Submitting an order — whether online, by phone, or via signed estimate or purchase order — constitutes a binding agreement, subject to product availability.

Orders are reviewed for accuracy, pricing, and freight considerations.

We reserve the right to decline any order due to supply constraints, technical errors, or availability changes.

If an order is declined, a full refund will be issued.
No additional terms submitted by a purchaser shall override these Terms & Conditions unless explicitly approved in writing by FoamTec.
Payment Terms
Full payment is required at the time an order is placed.

Credit cards are charged at checkout or when orders are processed by phone or email.

Orders are not scheduled for production until payment has been received.

FoamTec reserves the right to cancel any order at its discretion and issue a refund if necessary.
Taxes
Product pricing does not include applicable taxes or duties.
Customers are responsible for all sales, use, excise, value-added, or similar taxes associated with their purchase unless valid exemption documentation is provided.
Product Descriptions & Pricing
We make every effort to present accurate product descriptions and images. However:

Pricing may change based on market conditions.

Availability may change without notice due to manufacturing schedules.
FoamTec is not responsible for typographical errors or technical inaccuracies.
Color Variation & Ordering Recommendations
Because many FoamTec products are hand-finished, slight color variation between production runs is normal and within industry standards.
For best results:

Order all beams, panels, and materials for your project at the same time.

Plan for approximately a 10% waste factor when calculating quantities.
Future orders may not match previous finishes.
Screen displays can distort color, and lighting conditions significantly impact perception. We strongly recommend ordering samples before making a final purchase.
If requesting custom color matching, please provide a sample at least 8” x 12” and reference your project name or order number.
Design Services
Consultation with our Design Team for layouts, truss concepts, or detailed architectural planning may involve additional service fees.
To ensure the best outcome, customers should provide accurate measurements, architectural drawings when available, and budget expectations. If a proposed design cannot meet project or budget goals, alternative concepts may be discussed.
Shipping & Delivery
Shipping costs are not included in product pricing and must be paid in full prior to shipment.
FoamTec selects the freight method — typically third-party common carriers — at our discretion.
Important Delivery Responsibilities

Customers are responsible for unloading shipments unless liftgate or equipment service is arranged in advance.

Most deliveries arrive on approximately 53-foot trailers. Notify us ahead of time if access is limited.

Additional charges may apply for special delivery conditions such as address changes, redelivery, storage, or restricted access.
Shipping timelines are estimates only and cannot be guaranteed. FoamTec is not liable for delays, lost shipments, or freight damage caused by carriers.
Inspecting Your Shipment
Shipments must be inspected carefully before signing the delivery receipt.
If inspection cannot be completed immediately, write “SUBJECT TO INSPECTION” on the receipt and examine the shipment within the carrier’s allowed timeframe (typically 48–72 hours).
Freight Damage
Damage during shipping is the responsibility of the carrier.
If damage is visible:

Reject the shipment or damaged portion.

Ensure the driver notes the damage on the delivery receipt.

Photograph the product while still on the truck.
-
File a claim directly with the shipping company.
FoamTec cannot file freight claims on behalf of customers.
Hidden damage must be reported to the carrier within 48–72 hours or claims may be denied.
Storage & Accessorial Charges
Customers are responsible for any storage fees or additional carrier charges resulting from delayed delivery acceptance or inaccurate shipping information.
Misrepresentation of a delivery address (for example, listing a residence as a commercial location) may result in additional carrier fees billed to the customer.
No Refunds, Returns, or Cancellations on Custom Orders
Most FoamTec products are made to order. Once production begins, orders cannot be canceled.
Please review all specifications carefully prior to purchase.

Limited Warranty
FoamTec warrants to the original purchaser that products manufactured by FoamTec will be free from defects in materials and workmanship for two (2) years from the original shipment date when installed according to standard industry practices.
If a manufacturing defect is confirmed, FoamTec may, at its discretion:

Provide touch-up materials

Replace the defective product
-
Issue a refund for the original purchase price
This warranty does not include labor costs, removal, reinstallation, or associated construction expenses.
Repair or replacement does not extend the original warranty period.
The warranty is non-transferable.
Warranty Exclusions
This warranty does not cover damage resulting from:

Improper installation

Misuse or alteration
-
Exposure to harmful chemicals

Extreme heat
-
Impact or environmental events
-
Normal weathering or UV fading
-
Failure to follow building codes
FoamTec disclaims responsibility for damage caused by work not performed in accordance with accepted construction standards.
Third-party products are covered only by their respective manufacturers’ warranties.
Installation Responsibility
FoamTec is not financially liable for damage caused by installers, other trades, or shipping carriers — including fastener penetration, paint damage, tape residue, or construction-related impacts.
Always consult local building codes prior to installation.
Fireplace & Combustibility Notice
Our polyurethane products are combustible and must be installed according to national and local fire codes.

Maintain required clearances from fireplaces and stoves.
-
Use non-combustible borders when necessary.
-
Products are not suitable for fireboxes or hearth surfaces.
Consult your local building authority or fire marshal for compliance requirements.
Class-A fire-rated material is available upon request at the time of ordering.
Care & Maintenance
Interior Cleaning:
Use a soft cloth, feather duster, or mild soap solution.
Exterior Cleaning:
Rinse gently with low-pressure water. Avoid aggressive spraying.
To preserve finish quality, consider applying a UV-protective topcoat every 3–5 years, depending on sun exposure.
Do Not Use:

Abrasive cleaners
-
Bleach or ammonia
-
Acetone
-
Scrub brushes
-
Power washers
-
High-pressure nozzles
These can damage the finish.
Force Majeure
FoamTec is not liable for delays or failure to perform caused by events beyond our control, including natural disasters, labor disruptions, material shortages, transportation issues, or court orders.
Limitation of Liability
To the fullest extent permitted by law, FoamTec’s maximum liability is limited to repair, replacement, or refund of the product purchase price.
We are not liable for lost profits, project delays, business interruption, or consequential damages.
Governing Law
These Terms & Conditions are governed by the laws of the State of California and Arizona.
Any legal action shall be exclusively brought in the state or federal courts located in Sacramento, California, or Phoenix, Arizona.
Warranty Claims
Claims must be submitted within 30 days of discovering a potential defect and include proof of purchase and supporting photos.
